TERMS &
POLICIES.

01 DEFINITIONS

For these Terms:

Client means any individual or business purchasing creative or professional services from CREA.

Customer means any individual or business purchasing physical products from CREA.

Consumer means an individual acting for purposes outside their business, trade or profession.

Business Client means an individual or legal entity purchasing from CREA for professional or commercial purposes.

Services include, but are not limited to, brand strategy, creative direction, Brand Direction Intensives, content creation, photography direction, creative consulting, design support, ongoing creative partnerships and other services agreed between CREA and a Client.

Products include stickers, sticker sheets, stationery, printed goods, merchandise and any other physical products offered by CREA.

Custom Products are Products created, printed, personalised or otherwise produced according to a Customer's individual specifications.

Agreement means the agreement between CREA and the Client or Customer resulting from an order, accepted proposal, booking, written confirmation or other agreed purchase.

02 SCOPE OF SERVICES

CREA provides creative services including, but not limited to:

  • Brand Strategy & Creative Direction
  • Content Strategy
  • Social Media Strategy
  • Creative Consulting
  • Content Creation
  • Graphic Design Support
  • Brand Direction Intensives
  • Ongoing Creative Partnerships

The exact scope of work, deliverables, timelines, and pricing will be outlined in a separate proposal, invoice, or agreement.

03 BOOKING & FORMATION OF AN AGREEMENT

For products, an agreement is formed when CREA confirms the customer's order or otherwise accepts the order.

For services, an agreement may be formed and projects are officially secured when:

  • a proposal or quotation is accepted;
  • a deposit or agreed payment is made;
  • the client confirms the project in writing;
  • the client signs an agreement; or
  • CREA and the client otherwise clearly agree to begin the work.

Electronic acceptance, including acceptance by email or through an online booking or payment system, may constitute valid acceptance.

CREA reserves the right to decline projects that do not align with its values, availability, or expertise.

04 TIMELINES & DELAYS

Estimated timelines will be communicated at the start of the project. Any project timeline provided by CREA is an estimate unless expressly agreed as a fixed deadline.

Delays in communication, approvals, or asset delivery from the client may result in adjusted project timelines.

If CREA is unable to continue a project because required feedback, approvals, materials, information, or communication from the client have not been provided for fourteen (14) consecutive calendar days, CREA may place the project on hold. CREA will notify the client before doing so.

Projects placed on hold may be rescheduled according to CREA's current availability. Where restarting the project requires additional administrative, planning, production, or re-onboarding work, a reactivation fee may apply and will be communicated to the client in advance.

If the client remains unresponsive for thirty (30) consecutive calendar days, CREA may consider the project abandoned and close the project. Fees already paid and amounts due for work already completed remain payable.

05 COMMUNICATION & RESPONSE TIMES

Unless otherwise agreed, CREA conducts project communication through the communication channels specified for the project.

Clients should allow up to five business days for non-urgent project communication unless a different response time has been agreed.

Messages sent outside standard business days or during announced closures or holidays will be handled upon return.

Urgent, additional or unscheduled calls, consultations or meetings are not automatically included in a project unless specified in the agreed scope.

06 CLIENT RESPONSIBILITIES

The client agrees to:

  • Provide all required information, assets, and feedback in a timely manner.
  • Ensure all supplied materials are owned or properly licensed.
  • Review deliverables carefully before final approval.

CREA shall not be held responsible for delays resulting from missing information, late feedback, or incomplete materials.

07 PAYMENT TERMS

Deposits

Projects exceeding €300 may require a non-refundable deposit of 50% prior to commencement. Smaller one-off projects may require full payment upfront. Where a deposit or initial payment is required, the project is not secured until that payment has been received unless CREA agrees otherwise.

Payment Window

Invoices are due within three (3) calendar days of the invoice date unless otherwise agreed in writing.

Accepted Payment Methods

Payments may be made via bank transfer using the details provided on the invoice or given through cash.

Late Payments

Late payments may incur a late fee of 5% of the outstanding balance for every 14 days overdue.

CREA reserves the right to:

  • Suspend ongoing work.
  • Delay delivery of final files.
  • Refuse future work until outstanding balances are settled.

Payment terms will be specified in the relevant proposal, invoice or agreement.

08 CANCELLATIONS

Cancellation conditions may vary depending on the service and stage of the project.

If a client cancels after CREA has already begun work, CREA is entitled to payment for services reasonably performed up to the cancellation date.

For business clients, deposits, booking fees and completed work may be non-refundable where stated in the applicable proposal or agreement.

Any third-party expenses already incurred on behalf of the client may remain payable.

09 REFUND POLICY

Due to the custom nature of creative services, all payments made to CREA are non-refundable once work has commenced.

10 REVISIONS & FEEDBACK

The number of revision rounds included in a project will be stated in the relevant package, proposal or agreement.

A revision means an adjustment to work already created within the original approved direction.

A revision does not include:

  • a complete change in creative direction;
  • a change to the original brief;
  • new deliverables;
  • work that was previously approved and is later reconsidered;
  • new concepts after an agreed concept has already been developed; or
  • requests outside the original project scope.

Major changes to the approved direction may be considered outside the original scope and may require a revised quotation.

Clients are encouraged to provide consolidated feedback wherever possible.

11 OWNERSHIP & INTELLECTUAL PROPERTY

All concepts, drafts, strategy documents, moodboards, presentations, and creative materials remain the intellectual property of CREA until payment has been received in full.

Upon full payment:

  • Ownership of the final approved deliverables transfers to the client.
  • Preliminary concepts, rejected concepts, and unused creative work remain the property of CREA.

CREA retains the right to showcase completed work in portfolios, websites, social media, presentations, and promotional materials unless otherwise agreed in writing.

12 CONTENT CREATION & PRODUCTION

CREA specializes in social-first content creation and creative direction.

Content created by CREA may include content captured using mobile devices and basic production equipment.

Professional photography, videography, models, studio rentals, props, styling, or other production-related services are not included unless specifically stated in the proposal.

Third-party production costs will be quoted separately and require client approval prior to booking.

13 CREATIVE CONSULTATIONS

The initial discovery call with CREA is complimentary and is intended to discuss the client's needs, project scope, and potential collaboration.

Any consultation, meeting, brainstorming session, strategy session, or creative advisory service requested or conducted after the initial discovery call is considered a paid service, unless otherwise stated in the applicable service agreement or project package. Paid consultations are charged at the applicable rate communicated by CREA prior to the meeting. This applies to both online and in-person meetings.

A consultation fee covers the time reserved and professional creative and strategic expertise provided by CREA during the session. It does not include the execution or production of creative work unless explicitly agreed upon.

14 CREATIVE PARTNERSHIPS

Creative Partnerships are subject to the minimum commitment and renewal terms stated in the applicable proposal or agreement. CREA's current Creative Partnership offering has a minimum three (3)-month commitment unless otherwise agreed in writing.

After the minimum commitment, any continuation, renewal or termination terms will be governed by the applicable agreement. Unless otherwise agreed, either party may terminate an ongoing partnership after the minimum commitment with thirty (30) days' written notice.

Unused deliverables do not roll over to future months unless otherwise agreed.

15 CREATIVE DIRECTION & PROFESSIONAL JUDGEMENT

Clients hire CREA for its creative direction, strategic perspective, methodology and professional judgement.

CREA will consider the client's objectives, feedback, market, audience and brand context while retaining reasonable creative discretion over the execution of the agreed services.

Creative work is inherently subjective. A client's personal preference alone does not mean that services were defective or not delivered as agreed.

16 RESULTS & PERFORMANCE

CREA provides creative and strategic professional services but does not guarantee specific commercial outcomes.

Unless CREA explicitly guarantees a specific result in writing, CREA does not guarantee:

  • a specific number of followers;
  • sales or revenue;
  • social media reach;
  • engagement;
  • virality;
  • media coverage;
  • business growth;
  • conversions;
  • search rankings; or
  • any other particular business outcome.

Marketing, branding and content performance depend on numerous factors outside CREA's control.

17 OFFERS, PRICES & AVAILABILITY

All offers are subject to availability unless explicitly stated otherwise.

Prices displayed on the website or in a proposal are shown in the currency indicated at the time of purchase.

CREA product prices may differ by market. Aruba prices are set in AWG, while Netherlands/EU prices are set in EUR. Prices are determined separately for each market and are not direct currency conversions. The price shown or confirmed for the customer's market at the time of purchase is the applicable price for that order.

Shipping, delivery, production, third-party or additional project costs may be charged separately and will be communicated before the purchase or commitment where applicable.

CREA may change its prices at any time. Changes do not affect orders or agreements already confirmed.

Obvious typographical, technical, currency conversion, or pricing errors do not bind CREA if the customer could reasonably have understood that the displayed information was incorrect.

18 CURRENCY & CONVERSION

All CREA service prices are based in EUR unless otherwise stated. For clients paying in AWG, prices may be converted using the exchange rate applicable on the date the quotation or invoice is issued. Converted prices will be rounded to a practical amount. Once a quotation or invoice has been issued, the stated price is fixed for the validity period of that quotation or invoice.

19 LIMITATION OF LIABILITY

CREA shall not be liable for:

  • Indirect or consequential damages.
  • Loss of revenue, profit, or business opportunities.
  • Errors arising from incorrect information supplied by the client.

The client assumes full responsibility for reviewing and approving all final deliverables.

20 CONFIDENTIALITY

Both parties agree to maintain confidentiality regarding proprietary information, business strategies, and sensitive materials shared throughout the course of the project.

21 PRODUCT QUALITY & USE

Unless otherwise stated on the relevant product page, CREA stickers may be produced using materials described as 'vinyl', 'waterproof' or 'water-resistant' according to their relevant product specification.

Product performance may vary depending on surface preparation, exposure, temperature, friction, chemicals, dishwashing, weather, UV exposure and other environmental conditions.

22 PRODUCT AVAILABILITY & ORDERS

Products may be produced in limited quantities.

Customers are responsible for reviewing their order before submitting it.

The customer must provide complete and accurate:

  • name;
  • delivery address;
  • billing information;
  • contact details; and
  • other information reasonably required to process the order.

CREA is not responsible for delivery problems caused by incorrect information provided by the customer, although CREA will reasonably assist where possible. Customers should contact CREA as soon as possible if they notice an error after ordering.

Products purchased through retail partners

CREA products purchased through an independent retail partner are subject to that retailer's applicable purchase, return, exchange, and refund procedures. Customers should contact the retailer directly regarding purchases made through that retailer.

23 DELIVERY & SHIPPING

Shipping Provider

Orders within the Netherlands are shipped via PostNL. Available shipping methods and applicable shipping costs will be communicated or displayed at the time of ordering.

Aruba Orders

Pickup or local delivery options may be offered where available.

Where CREA products are purchased from an independent retail partner, that retailer's own purchase and return procedures may apply to the transaction, together with any mandatory consumer rights.

Processing Time

CREA aims to prepare and dispatch orders within the stated processing timeframe. Processing time refers to the time required to prepare an order and does not include the delivery time of the shipping carrier.

Tracking

Where the selected shipping method includes Track & Trace, tracking information will be provided to the customer once the order has been dispatched.

Delayed or Missing Orders

If an order has not arrived within the expected delivery period, the customer should contact CREA so that the shipment can be reviewed and, where applicable, an investigation can be initiated with PostNL.

A delay caused by the shipping carrier does not automatically entitle the customer to a refund or replacement.

Lost or Damaged Shipments

If an order arrives damaged, the customer should contact CREA as soon as reasonably possible and provide clear photographs of the packaging and damaged products.

CREA will assess the situation and, where appropriate, contact PostNL and arrange a suitable solution in accordance with applicable consumer rights.

Unclaimed or Returned Shipments

If an order is returned to CREA because it was not collected, could not be delivered, or was refused by the recipient, the customer may be responsible for the additional cost of reshipping the order.

International Shipping

For orders shipped outside the Netherlands, delivery times may vary depending on the destination, local postal services, customs procedures, and other circumstances outside CREA's control.

Any applicable customs duties, import taxes, or local handling charges are the responsibility of the customer unless otherwise stated at the time of purchase.

24 WHOLESALE & BUSINESS CUSTOMERS

Separate wholesale pricing, minimum quantities, payment terms and delivery conditions may apply to approved retailers and business clients.

Wholesale products are purchased for authorised resale only. A retailer may not reproduce CREA products or artwork.

Unless CREA agrees otherwise in writing, purchasing wholesale stock does not grant:

  • exclusivity;
  • territorial rights;
  • intellectual property rights;
  • distribution rights beyond resale of the purchased products; or
  • permission to manufacture or reproduce CREA designs.

Please include enough information for CREA to identify the relevant project or order and understand the issue.

CREA will aim to acknowledge and address complaints within a reasonable period.

26 ACCEPTANCE

By proceeding with payment, approving a proposal, signing an agreement, or engaging CREA's services, the client confirms acceptance of these Terms & Conditions.

CREA may update these Terms from time to time, for example, to reflect changes in services, products, or business operations.

The latest version will be available on CREA's website together with its last updated date.
